2. Our Services

After Hours Entertainment provides DJ services, event entertainment, photo booths, lighting, sound equipment, and related services for weddings, parties, corporate events, and other special occasions across Long Island and the New York City area.

2.1 Service Description

Our website provides information about our services, allows you to request quotes, contact us about bookings, view our portfolio, and read information about venues and event planning. We may occasionally update or modify our services without prior notice.

2.2 Service Limitations

Our ability to provide services is subject to availability, weather conditions, venue restrictions, and other factors beyond our control. We reserve the right to refuse service to anyone for any reason at any time.

3. Intellectual Property Rights

3.1 Website Content

Unless otherwise stated, After Hours Entertainment and/or its licensors own the intellectual property rights for all material on the website. All intellectual property rights are reserved. You may view and/or print pages from the website for your own personal use subject to restrictions set in these Terms.

3.2 Restrictions

You must not:

• Republish material from our website
• Sell, rent, or sub-license material from our website
• Reproduce, duplicate, or copy material from our website
• Redistribute content from our website (unless content is specifically made for redistribution)

3.3 User Content

When you submit content to our website (such as reviews, testimonials, or photos), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content in any existing or future media. You also grant us the right to sub-license these rights and the right to bring an action for infringement of these rights.

4. User Accounts and Responsibilities

4.1 Account Security

If you create an account on our website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.

You must provide accurate, complete, and up-to-date contact information. You agree to update this information promptly if it changes. Failure to provide accurate information may result in termination of your account.

4.3 Prohibited Activities

You agree not to use our Service for any purpose that is unlawful or prohibited by these Terms. You may not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.

5. Booking and Reservations

5.1 Event Booking Process

Booking an event with After Hours Entertainment requires a signed contract and a deposit. The booking is not confirmed until we have received both the signed contract and the required deposit. Availability is on a first-come, first-served basis.

5.2 Event Requirements

It is the client's responsibility to ensure that the venue is appropriate for our services, including adequate space, power requirements, and setup time. Any special requirements must be communicated to us at the time of booking.

5.3 Changes to Bookings

Any changes to the date, time, duration, or location of the event must be communicated to us as soon as possible. We will try to accommodate changes, but cannot guarantee availability. Additional fees may apply for changes made less than 30 days before the event.

6. Payments and Cancellations

6.1 Payment Schedule

To secure a booking, we require a non-refundable deposit (typically 25% of the total fee). The remaining balance is due 14 days prior to the event date, unless otherwise specified in your contract.

6.2 Accepted Payment Methods

We accept payments via credit card, debit card, electronic bank transfers, and checks (subject to clearance before the event date). Cash payments must be arranged in advance.

6.3 Cancellation Policy

Our cancellation policy is as follows:

• Deposits are non-refundable
• Cancellations made more than 90 days before the event: 75% refund of any payments made beyond the deposit
• Cancellations made 30-90 days before the event: 50% refund of any payments made beyond the deposit
• Cancellations made less than 30 days before the event: No refund

6.4 Rescheduling

We understand that circumstances may require rescheduling. If you need to reschedule, please contact us as soon as possible. Rescheduling is subject to our availability. A rescheduling fee may apply depending on the notice given.

7. Limitation of Liability

To the maximum extent permitted by applicable law, After Hours Entertainment, its directors, employees, agents, vendors, and licensors shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, that result from:

• The use of, or inability to use, the Service
• Any disruption or failure of our services
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Service
• Equipment failure or malfunction
• Force majeure events including but not limited to natural disasters, power outages, venue restrictions, pandemics, or other events beyond our reasonable control

In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid us in the last six (6) months, or, if greater, one hundred dollars ($100).

8. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

After Hours Entertainment does not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements

9. Indemnification

You agree to defend, indemnify, and hold harmless After Hours Entertainment, its directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your conduct in connection with the Service
• Any content you submit to the Service

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of New York State, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10.1 Dispute Resolution

Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10.2 Class Action Waiver

You agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
